An independent regulator should be able to make decisions within the scope of its authority without interference from Government or individual ministers. There should be a strong presumption in favor of establishing an independent regulator or regulators to regulate infrastructure. When there is lack of capacity/expertise, an interim solution could be a regulator within a Ministry.

An independent regulator will promote confidence through impartial and objective decisions; ensure neutrality regarding state-owned and private companies; implement public policy while determining details and specific rules; be subject to accountability and transparency; and avoid regulatory capture.

Regulators require governance arrangements that ensure that they operate effectively, providing for high-quality decision-making, safeguarding the agency’s regulatory integrity and thereby delivering the regulatory objectives of its mandate.
